When push comes to shove and lawsuits are being strewn about like a bad joke, just remember - Apple bites back!

For those of you that are unaware of the rotten proceedings, The Open Group (TOG) is suing Apple Computer, Inc. for their use of the term "Unix Based" when referring to OS X. In an article from news.com, TOG was quoted as saying "we do care about customers and users of Unix systems who depend on the Unix trademark as an indicator of trust."

As macobserver.com reports, "More importantly, the Cupertino, CA company has counter-sued TOG to get the Unix trademark invalidated because, [as] the company says, the term has come to be generic in nature." Although I agree to a certain extent, Unix is still Unix. The BSD OSes, Linux OSes, and now Mac OS X are all "based" on Unix, but does that make them generic? Irregardless, this has offered the Unix community the chance they needed to prove that they can be a little anal.

As an article from Silicon.com states, "Though initiated nearly 18 months ago, the case has not yet gone to trial." Who knows how long this dispute will last, I just can't believe that it all started over a misspelling! Yes, you heard it here first. It is true that Apple originally based this OS on a Unix variant, and with that in mind, it was created by geeks, for geeks - making it based on eunuchs.

A typo, a simple marketing campaign gone bad, or a clever play on words? You decide!
